The Michigan Department of Transportation tells 95.3 WBCK an incorrect land survey may have led to a contractor taking down trees near the former Battle Creek Don Pablo's property which should not have been cut down.

MDOT spokesman Nick Schirripa said a MDOT employee happened to notice the trees were cut down as he passed by the property several weeks ago. The trees were on MDOT property and should have remained. The owner of the Don Pablo's property could have requested a permit to remove the trees, but Schirripa said that did not happen.

Schirripa said the state and the property owners are now working to arrive at a solution to the issue. Don Pablo's Mexican Kitchen in Battle Creek closed abruptly in October 2016.
