Those facing criminal marijuana charges in Kalamazoo County might be getting a break.

MLive says that Kalamazoo County Prosecutor Jeff Getting has announced he will be dismissing marijuana charges that fall under what Michigan’s Proposal 1 will make legal; under Prop 1, which will go into effect once the state Board of Canvassers certifies the election results, individuals 21 or older will be allowed to possess up to 2.5 ounces of marijuana on their person, and up to 10 ounces secured in their home; they will also be allowed to grow up to 12 plants in their home for personal use.

Getting says that those who had more than the legal amount of the plant, or those who were selling it, are still going to be charged. It’s predicted that several hundred marijuana possession charges will be dismissed with this new plan.

In addition to dropping charges, the prosecutor's office notified county law enforcement agencies that they would no longer accept new charges for things that would be legal under Proposal 1, even though the law has yet to go into effect and the possession of weed remains illegal.
