A lawsuit has been filed in Calhoun County alleging that an Albion police officer struck and pepper sprayed a handcuffed autistic teen during an incident on November 24, 2018.

The lawsuit says that the 13 year old's civil rights were violated during the incident, which was recorded on a police body camera. The lawsuit also says the boy has mental health problems and was experiencing an emotional crisis. In fact, the family had called the Albion Department of Public Safety three times prior to the incident for help with the teen without issue.

The teen was arrested after police were called to his home for possible assaultive behavior. The lawsuit says he was punched after spitting at an officer. The 13 year old was charged with multiple counts of assault and battery and resisting arrest. However, according to his attorney, those charges were later dismissed.

The officer who is alleged to have hit and pepper sprayed the teen was fired in February following a review of the incident.

The Albion Department of Public Safety has yet to comment on the lawsuit.
