Sentencing took place in Calhoun County Monday for a man involved in an accidental shooting death from this year.

The Battle Creek Enquirer reports that 26-year-old Deangelo Gaines will be facing 2 years’ probation and almost $9,000 in fines and restitution, but no jail time. Gaines was charged after his girlfriend, 24-year-old Kayla Babick, was shot and killed on Valentine’s Day at a home on Highway St. in Battle Creek.

Authorities say that she had lay down on a handgun, and the gun went off when she attempted to move it.

The firearm was determined to belong to Gaines, and he did plead no-contest in October to a charge of reckless discharge of a firearm causing death.
